Green Card for Parents

If you are an adult U.S. citizen with immigrant parents, you can apply for a green card in their name with USCIS. The parent green card is immediately available to foreign parents of U.S. citizens who are 21 years of age or older, as they are considered immediate relatives. The process will be different depending on the immigration status of your parents.

This process is for persons with a pending or approved I-130 petition, as well as for persons who are legally eligible to adjust status with a U visa, T visa, VAWA-based I-360, SIJS, widow/widower.

This filing is used by active duty, reservist and veterans filing for their spouse, children under the age of 21 and parents.

Two-part process:

PART 1- J1 Exemption from the home residence requirement

PART 2- Adjustment of status: I-130 with I-485

No objections: $2370 – $3650

Exceptional hardship: $3470 – $4750

This finding is for persons currently in the United States in J1 visa status (or have held this visa in the past) who are subject to the 2-year household residency requirement. This is a two-part process, which requires a J1 waiver approval to move to adjustment of status.
